Ancillary Events Credential

This credential (“Credential”) is issued by Las Vegas Grand Prix, Inc. (“LVGP”) and may be revoked by LVGP at any time, for any reason, in LVGP’s sole discretion.  By attending certain events (each an “Event”) related to the Formula 1 Las Vegas Grand Prix, you acknowledge, accept and agree to the terms and conditions listed on this Credential on behalf of yourself, and on behalf of any attendee under the age of 18 accompanying you (each an event “Participant”).  All Participants under the age of 18 must be accompanied by a parent or legal guardian.  Participant agrees that being permitted to participate in the Event is good and valuable consideration made in exchange for Participant’s acceptance of and agreement with the terms and conditions below.

Except to the extent restricted by the Event’s prohibited items policy, personal electronic devices (including still image cameras, phones and other handheld devices) are permitted at the Event; however, any images, recordings or data created, recorded or stored thereon from the Event shall only be used for personal, private and non-commercial purposes. On request of LVGP, Participant shall assign to LVGP in writing (or procure such assignment) all intellectual property rights in any images, films and recordings created and/or recorded by Participant at the Event.  Participant grants LVGP, its successors and assigns, an irrevocable, perpetual, worldwide, royalty-free right, but not the obligation, to photograph, film, record, broadcast, exhibit, distribute and otherwise exploit in any and all media throughout the world Participant’s activity/performance in the Event and to use Participant’s name, likeness, voice and biographical information in connection therewith without any compensation being paid to Participant. Participant acknowledges and agrees that LVGP is the sole owners of all rights, title and interest in and to the materials developed in connection with the Event, and any derivative works thereof, and any photographs, film, video, digital or electronic recordings made or taken of Participant in connection with the Event (collectively, the “Materials”), including but not limited to any rights of intellectual property, including copyright, and that Participant shall have no interest or ownership in the Materials. Participant waives the opportunity or right to inspect or approve the Materials or any of the uses to which they may be put.  Participant acknowledges that he/she has no expectation of privacy in connection with Participant’s attendance at, or participation in, the Event. Participant agrees not to assert any claim, action, suit or demand of any kind or nature whatsoever against LVGP, including but not limited to those grounded upon invasion of privacy, rights of publicity, or other civil rights, in connection with LVGP’s use of the Materials, use of Participant’s name, likeness, voice or biographical information as provided herein.

Participation in the Event is entirely voluntary. Participant understands and voluntarily assumes all risks, hazards and dangers associated with such participation, including personal injury, exposure to communicable diseases, viruses and illnesses, and lost, stolen or damaged property.  Participant understands that there may be inherent risks associated with participation in the Event, such as injuries, concussions, and in some cases death, and Participant understands and is willing to assume these risks. Participant agrees that during the Event, LVGP and its agents are authorized to secure appropriate medical attention for Participant in the event of an accident, illness or injury. Participant agrees to be responsible for any and all costs of medical coverage and treatment not covered by his/her insurance.

Participant releases and forever discharges all entities and persons associated and affiliated with the Event, including but not limited to Las Vegas Grand Prix, Inc., LV Diamond Property I, LLC, Formula One World Championship Limited, Liberty Media Corporation, the owners, operators or licensors of the facilities being accessed, and each of their respective affiliated entities, and each of their respective officers, directors, employees, contractors, representatives and agents. (together, the “Released Parties”) from any and all claims or liabilities, in equity and law, including but not limited to personal injuries (including death) and/or damages that Participant and/or Participant’s property may sustain in connection with use of the facilities or the Event, even if those claims or liabilities arise out of the negligence or carelessness of one or more of the Released Parties. Participant understands that the number and magnitude of the claims and liabilities released hereto may not currently be fully known, but nevertheless to release those unknown claims.  Participant further agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all demands, claims, disputes, actions, causes of action, losses, damages, penalties, recoveries, judgments or executions, costs, and expenses (including attorneys fees), of any and every kind, arising from or in connection with Participant’s use of the facilities and/or participation in the Event, except to the extent arising from the gross negligence or willful misconduct of the Released Parties.

Participant agrees to abide by all rules and regulations pertaining to the Event.
