TICKET PAYMENT PLAN TERMS AND CONDITIONS

PLEASE READ THIS AGREEMENT CAREFULLY AND IN ITS ENTIRETY. THIS AGREEMENT, WHICH IS A LEGALLY BINDING DOCUMENT, INCLUDES, AMONG ITS OTHER TERMS, LIMITATIONS AND CONDITIONS (INCLUDING LIMITATIONS ON LIABILITY), A NO REFUND POLICY (AND OTHER RELATED RESTRICTIONS), ARBITRATION REQUIREMENTS RELATIVE TO DISPUTE RESOLUTION AND WAIVERS OF IMPORTANT LEGAL RIGHTS.

BY ENTERING INTO THIS AGREEMENT, YOU ACKNOWLEDGE THAT YOU ARE FREELY AND VOLUNTARILY GIVING UP IMPORTANT LEGAL RIGHTS. IF YOU DO NOT AGREE WITH ANY OF THE TERMS, WAIVERS, LIMITATIONS, RESTRICTIONS AND/OR OTHER CONDITIONS SET FORTH IN THIS AGREEMENT, OR IF YOU DO NOT AGREE WITH, OR AGREE TO ASSUME, THE RISK(S) TO YOU AS SET FORTH IN THIS AGREEMENT, DO NOT PURCHASE TICKETS AND/OR DO NOT PARTICIPATE IN THE PAYMENT PLAN.

These terms and conditions are applicable to any payment plan (a “Payment Plan”) you select in connection with the purchase of any ticket(s) to attend a Formula 1 Las Vegas Grand Prix (the “Event”) promoted by Las Vegas Grand Prix, Inc. (“Promoter”). There is no additional fee for selecting a Payment Plan. The Payment Plan is applicable only to the ticket order selected for the Payment Plan. The Promoter reserves the right to refuse to accept or cancel any Payment Plan in its sole and absolute discretion. The Payment Plan must be selected at the time of purchase. The Payment Plan is not a credit sale or other extension of credit.

By electing to purchase any ticket(s) with a Payment Plan, you agree to all terms, conditions, waivers, limitations, restrictions and/or conditions set forth herein, as well as all other ticket terms and conditions on the Promoter’s website or provided to you by Promoter at any time. Without limiting the foregoing, the Payment Plan is subject to the terms and conditions of the Promoter’s ticket terms at https://www.f1lasvegasgp.com/ticket-terms/. If you do not agree to these Payment Plan terms and conditions, do not purchase ticket(s) or do not participate in the Payment Plan.

BY SELECTING A PAYMENT PLAN, YOU: (1) REPRESENT THAT YOU HAVE THE AUTHORITY TO AUTHORIZE CHARGES TO THE CREDIT CARD OR DEBIT CARD YOU PROVIDED AT THE TIME OF PURCHASE (“PAYMENT METHOD”); (2) AUTHORIZE PROMOTER TO AUTOMATICALLY CHARGE THE PAYMENT METHOD OVER A FIXED PERIOD OF TIME IN INSTALLMENTS; (3) AGREE THAT NO PRIOR NOTIFICATION IS REQUIRED TO BE PROVIDED BY THE PROMOTER PRIOR TO PROCESSING MONTHLY INSTALLMENTS (UNLESS THE DATE OR AMOUNT OF THE PAYMENT IS CHANGED BY PROMOTER, IN WHICH CASE, NOTICE WILL BE PROVIDED BY PROMOTER IN ADVANCE OF ANY SUCH PAYMENT PROCESSING); AND (4) AGREE THAT YOU ARE RESPONSIBLE FOR NOTIFYING PROMOTER IMMEDIATELY OF ANY CHANGES IN YOUR PAYMENT METHOD, INCLUDING WITHOUT LIMITATION, IF YOUR PAYMENT METHOD CARD NUMBER OR EXPIRATION DATE CHANGES AND THAT FAILLURE TO DO SO MAY RESULT IN CANCELLATION OF THE TICKET ORDER IF PAYMENT CANNOT BE PROCESSED AS A RESULT.

The Payment Plan requires you to make an initial payment in the amount indicated at the time of purchase (the “Installment Amount”). Thereafter, Promoter will automatically charge the Installment Amount to the Payment Method each month until the total purchase price of the ticket(s) has been received by Promoter. The Installment Amount will be collected on the fifteenth day of every month, commencing with the first calendar month following the initial date of purchase (by way example only, if you purchase any ticket(s) on April 10 you will pay the first Installment Amount, and then your next payment of the Installment Amount will be processed on May 15). All Payment Plans must be paid in full by August 15 of the calendar year in which the Payment Plan commenced. You will not receive the tickets until the total amount due pursuant to the Payment Plan has been collected by Promoter.

If, for any reason, you fail to make a payment when due, your account will be in default and Promoter shall have the right to cancel all (or a portion) of the ticket(s) contained in your order if Promoter is unable to contact you to collect payment and/or you fail to make such payment within ten (10) days of the due date. The Promoter reserves the right to charge an additional fee for any payment declined, returned or denied. If any amount payable to the Promoter is not paid when due, such amount will bear interest until paid at a rate equal to the lesser of (i) 1.5% per month and (ii) the maximum rate permitted by law, and the Promoter shall have the right to withhold any or all of the benefits granted pursuant to these terms during the period in which such amounts remain unpaid.

IN THE EVENT OF A CANCELLATION OF YOUR TICKETS, INCLUDING AS A RESULT OF DEFAULT AND/OR PROMOTER IS UNABLE TO CONTACT YOU, THEN (1) YOU WILL RECEIVE A CREDIT ON FILE WITH PROMOTER FOR THE AMOUNT YOU HAVE PAID AS OF THE DATE OF DEFAULT OR CANCELLATION (THE “CREDIT”) AND (2) YOU WILL NOT RECEIVE ANY REFUND. THE CREDIT MAY ONLY BE USED TOWARDS THE PURCAHSE OF TICKETS TO THE NEXT ITERATION OF THE FORMULA 1 LAS VEGAS GRAND PRIX (THE “NEXT RACE”), BUT IN NO EVENT SHALL THE CREDIT BE REFUNDED. THE DEADLINE TO USE ANY CREDIT IS THE EARLIER OF (i) THE DATE THE NEXT RACE IS SOLD OUT; OR (ii) THE LAST DAY TO PURCHASE TICKETS FROM PROMOTER FOR THE NEXT RACE. ANY CREDIT NOT USED PRIOR TO SUCH DEADLINE IS FOREFEITED TO PROMOTER AND WILL NOT BE REFUNDED.

NO REFUNDS OF ANY AMOUNTS MADE TOWARDS THE PURCHASE OF TICKETS SHALL BE MADE EXCEPT AS MAY BE CONTEMPLATED BY PROMOTER’S TICKET TERMS, OR UNLESS OTHERWISE DETERMINED IN PROMOTER’S SOLE AND ABSOLUTE DISCRETION. You can find Promoter’s ticket terms at https://www.f1lasvegasgp.com/ticket-terms/.

The Promoter reserves the right to terminate, supplement, amend or otherwise modify these Payment Plan terms and conditions, or impose new conditions, at any time and it is your responsibility to check these terms periodically for changes. The Promoter will endeavor to provide notice to you of such modifications, to be communicated through one or several methods as determined and selected solely by the Promoter. Methods the Promoter may employ by way of example only are (i) posting on this or another page of the Event’s website and/or (ii) emailing to any email address that you provided to the Promoter. Changes to the Payment Plan terms and conditions shall be deemed effective as of their stated effective or modification date.

Any dispute between you and the Promoter concerning these Payment Plan terms and conditions will be resolved in accordance with the dispute resolution provisions contained in the ticket terms (including specifically but without limitation, the arbitration consent, class-action waiver, choice of law and venue provisions). You can find Promoter’s ticket terms at https://www.f1lasvegasgp.com/ticket-terms/.
